Your reason for challenging the CCJ
-
Determine the appropriate steps that you will need to take to implement a successful removal from your personal or business credit report.
So in this article I’m going to provide you with a list of strategies, that can be applied to your own situation, all of which will eventually lead to the same solution and that is - freeing your personal or business credit file from the constraints of a county court judgment that has the potential to damage your financial wellness.
Assess your current position
1. Can you pay back the creditor the full amount of the money within a month of the date of the CCJ?
Take the next step- If you agree that you owe the judgement debt and can afford to pay it in full within 30 days, you should do so as soon as possible. This will prevent a CCJ from being issued against you. It will not be placed on your credit report, and it will not affect your credit report. So, get in touch with the creditor immediately
2. Are you open to communication and negotiate with the creditor?
Take the next step- If you agree that you owe some of the money but cannot afford to pay it in full within 14 days, you should contact the creditor and tried to negotiate a payment arrangement that suits both of you.
You should fill in the admission form that comes with the claim form and send it back to the court. The court will then decide how much you have to pay based on your income and expenses. You may have to pay some interest and costs as well. Upon completion of the re-payment (if it falls outside the 30-day time limit) apply to the court for a Certificate of Satisfaction. It will not remove the CCJ, however it will help to improve your credit score
3. Are you disputing a CCJ?
If you disagree that you owe the debt, or the amount claimed, you should apply to the court to have the CCJ set aside and removed from your credit file. To challenge the claim, you should also provide any evidence that support your case.
-
Take the next step: You can contact the creditor to negotiate and settle with an agreement
-
Take the next step: Or if the creditor is not open to discussions, the court would then decide whether to accept or reject your application at a hearing. If the court accepts your application, based on a valid defence, the claim will be dismissed, and you will not have to pay anything and the CCJ will be set and set aside and not entered upon your personal or business credit file.
-
Take the next step: Further you can apply to the court for an order for the creditor to pay your costs of making the application.
As an expert CCJ removal service we assist professionals and businesses to navigate the court process, preparing applications and supporting evidence for effective presentation before the court for the purpose of removing a judgment order.
For example, we helped a business owner who was informed by his finance broker that a default judgment CCJ had been applied to his business credit file by a judgment creditor in respect of unpaid goods. We found out that our client had not been served correctly with the court issue papers.
It was clear that the business name and registered service address for service had been entered incorrectly on the court claim by the claimant in the action, hence our client was denied the opportunity to defend the claim.
Our client applied to the court to have the successfully CCJ removed from the business file on the basis that the judgment was not enforceable, further was able to recover costs from the Claimant as they had refused to enter into negotiations to settle the action by way of an agreement.
A county court judgment expires after 6 years. It will automatically be removed from your credit file. If you are unsure contact the court and credit reference agencies and the Registry to request an automatic removal from the Register
