DEFAULT REMOVAL THE KEY FACTS

  • How long it lasts: six years from the default date  paid or unpaid.
  • When it can be removed early: only where it was recorded in error a defective or missing default notice, the wrong date or amount, a debt that isn't yours, or a default added while you were paying.
  • If you pay it: the marker changes to "satisfied" but does not drop off early.
  • If the lender won't correct it: the Financial Ombudsman can order removal where the rules were broken.

WHAT IS A DEFAULT AND WHAT IS A NOTICE OF DEFAULT ?

A notice of default (or default notice) is the formal letter your lender must send under the Consumer Credit Act 1974 before they can register a default  it has to give you at least 14 days to put things right. A default is the marker that follows if the arrears aren't cleared, recorded on your credit file with Experian, Equifax and TransUnion.

 

Note: in the UK this refers to a credit-file default, not the US mortgage-foreclosure meaning of "notice of default".
